2027 Steppers Cruise and Louisiana Groove Cruise
TRIP PARTICIPANT LIABILITY WAIVER RELEASE AND INDEMNIFICATION AGREEMENT
This Trip Participant Liability Waiver Release and Indemnification Agreement ("Agreement") is executed by the undersigned participant ("Trip Participant") in connection with the 2027 Steppers Cruise and Louisiana Groove Cruise aboard the Carnival Dream, departing New Orleans, Louisiana, on September 18, 2027, and returning to New Orleans on September 23, 2027, with scheduled calls at Cozumel, Mexico, followed by Progreso, Yucatan, Mexico ("Trip"). Port availability, port order, and the itinerary are subject to change because of weather, operational conditions, or decisions of Carnival Cruise Line.
This Agreement is given in favor of Abrams Rothchild LLC of Houston, Texas; Erica Luxe Travel of Kingwood, Texas; and Cumulus Media Inc. of Atlanta, Georgia, collectively referred to as the "Trip Sponsors." The Trip Participant understands that signing this Agreement is a condition of receiving event passes and participating in activities associated with the Trip.
1. Eligibility and reliance. The Trip Participant submits this Agreement with the understanding that the Trip Sponsors will rely on it in determining eligibility to participate in the Trip and related activities. The Trip Participant represents that the Trip Participant is at least 21 years old.
2. Voluntary participation. The Trip Participant undertakes the Trip freely and voluntarily. The Trip Participant acknowledges that travel and participation may involve danger to the Trip Participant, other persons, and property, and voluntarily chooses to participate despite those risks.
3. Scope and independent providers. This Agreement applies from embarkation through final disembarkation and includes travel aboard the ship, group activities, time in port, shore activities, excursions, transportation, and activities chosen or arranged independently by the Trip Participant. The Trip Sponsors do not own or control Carnival Cruise Line, transportation providers, excursion operators, port authorities, medical providers, or other independent vendors and are not responsible for their acts or omissions.
4. Assumption of risk and release. In consideration of being permitted to participate, the Trip Participant knowingly assumes all risks connected with the Trip and releases the Trip Sponsors from all claims, demands, damages, actions, causes of action, obligations, costs, losses, liabilities, bodily injury, death, property damage, or other injury or damage of any nature, whether known or unknown, arising from or related to the Trip. This release includes claims arising from the ordinary negligence of a Trip Sponsor to the fullest extent permitted by Texas law.
5. Release on behalf of others. The Trip Participant, on behalf of the Trip Participant and the Trip Participant's heirs, estate, successors, assigns, and legal representatives, forever releases and discharges the Trip Sponsors from claims arising from or related to participation in the Trip, including claims involving personal injury, death, property loss, or the possession or consumption of alcoholic beverages.
6. Covenant not to sue. The Trip Participant agrees not to sue a Trip Sponsor on any claim, demand, cause of action, damage, loss, liability, or expense arising from or related to the Trip, including a claim based on a Trip Sponsor's ordinary negligence or a claim related to the Trip Participant's possession or consumption of alcoholic beverages, to the fullest extent permitted by Texas law.
7. Indemnification. The Trip Participant agrees to indemnify and hold the Trip Sponsors harmless from claims, injuries, damages, liabilities, losses, costs, and reasonable attorneys' fees arising from or connected with the Trip Participant's acts, omissions, conduct, activities, rule violations, or participation in the Trip.
8. Transportation and all aboard times. The Trip Participant is solely responsible for boarding and departing any transportation at the required times and for returning to the ship before each published all-aboard time. If the Trip Participant misses transportation or the ship at any port, the Trip Participant is solely responsible for arranging and paying for transportation, lodging, meals, and all other resulting expenses.
9. Events beyond the Trip Sponsors control. The Trip Sponsors are not responsible for delays, cancellations, missed ports, changes in port order or itinerary, weather, mechanical problems, government actions, public-health events, labor disruptions, or other circumstances beyond their control. If Carnival cancels the entire sailing, any refund or future cruise credit will be determined solely under Carnival's policies, and the Trip Sponsors do not guarantee reimbursement.
10. Insurance and emergency expenses. The Trip Participant is responsible for obtaining appropriate travel and medical insurance. The Trip Participant is solely responsible for medical care, evacuation, cancellation, delay, quarantine, emergency transportation, and related expenses.
11. Personal property. The Trip Sponsors are not responsible for lost, stolen, delayed, or damaged luggage, personal property, passports, identification, or travel documents.
12. Cruise line terms. This Agreement is separate from and does not replace Carnival's passenger ticket contract, policies, or other terms that apply to the Trip Participant.
13. Rules and refunds. The Trip Participant agrees to follow Carnival's rules, applicable port regulations, and the Trip Sponsors' event policies. A violation may result in removal from group activities or loss of event privileges. All deposits and payments are nonrefundable, including when a participant cancels, fails to attend, violates applicable rules, or loses access to group activities, subject only to Carnival's policies if Carnival cancels the entire sailing.
14. Media release. The Trip Participant authorizes the Trip Sponsors to record, broadcast, publish, reproduce, and use the Trip Participant's name, city of residence, photograph, video, film, voice, and likeness, whether recorded or live, for promotional or other lawful purposes without compensation, unless prohibited by law. The Trip Participant releases all claims against the Trip Sponsors arising from that use and assigns to the Trip Sponsors any rights the Trip Participant may have in materials created and used for those purposes.
15. Governing law venue and severability. Texas law governs this Agreement. Any legal action relating to this Agreement must be brought exclusively in a state or federal court located in Harris County, Texas. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect. This Agreement binds the Trip Participant's heirs, estate, successors, assigns, and legal representatives.
I HAVE READ THIS AGREEMENT, INCLUDING THE ASSUMPTION OF RISK, RELEASE OF LIABILITY, COVENANT NOT TO SUE, AND INDEMNIFICATION PROVISIONS. I FULLY UNDERSTAND AND AGREE TO ITS TERMS AND SIGN IT VOLUNTARILY WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE.
